  1. Florida foreclosure law is shaped by the lien theory concept. This theory holds that property that is bound by a mortgage contract is considered collateral until the contract is fulfilled. The property is owned by the borrower, and the contract simply represents a lien on the property.
  2. Judicial Foreclosure

  3. Florida recognizes the judicial foreclosure process. This process requires the lending agent to sue the borrower for lack of payment. The purpose of this order is to obtain a court order to foreclose on the property. This foreclosure order must specify the terms of the sale, including any advertisements, location and any other requirements.

  1. When a property has mortgage liens placed against it, each lien takes a certain position, based on the order in which the mortgages were filed. For example, the mortgage filed first is in first position. The next lienholder is in second position, and is commonly called the second mortgage. If the first mortgage is paid off, the second mortgage moves into first position, and a third mortgage, if present, moves into second. Position indicates the order that the mortgages are paid off when the house is sold.

Affordable Health Care Benefits 3 Million to Date, Strengthens Medicare

Kathleen Sebelius announced three million Medicare beneficiaries have received prescription drug cost relief to date as the result of the Affordable Health Care Act.

Health care reform has resulted in a reimbursed of $250 to Medicare recipients falling into the stage 2 Medicare coverage gap, or donut hole. In a press release, Secretary Sebelius says, “The Affordable Care Act offers long overdue relief by lowering prescription drug costs each year until the donut hole is closed.”

Though the rebates will help, for many Medicare beneficiaries, it’s a drop in the bucket, for those hemmed in by brand name medications for which there are no generic substitutes.

House Republicans To Introduce Bill Expanding Restrictions On Insurance Coverage Of Abortion

House Republicans on Thursday will introduce a bill (HR 3) that they claim would “permanently end taxpayer funding of abortion and codify the Hyde Amendment” — which is added into appropriations legislation annually to prohibit federal funding for abortion care, except in cases of rape, incest or danger to a woman’s life, CQ Today reports (Ota, CQ Today, 1/19). House Speaker John Boehner (R-Ohio), Majority Leader Eric Cantor (R-Va.) and Congressional Pro-Life Caucus Co-Chair Rep. Christopher Smith (R-N.J.) will hold a press conference to introduce the bill today (Ryan, “Floor Action,” The Hill, 1/19).
